Daliah Saper speaks at the Illinois State Bar Association on Copyright Issues on the Internet

On Tuesday, June 9, 2009, Daliah Saper will be speaking at a Continuing Legal Education (CLE) seminar offered by the Intellectual Property Section of the Illinois State Bar Association. The seminar is entitled “Intellectual Property Essentials and IP on the Internet.” Daliah’s presentation will focus on “Copyright Issues on the Internet.”

Intellectual property issues can be tough to recognize for many general practice and commercial law attorneys. This program provides a broad overview of intellectual property issues, which will enable attorneys to reasonably counsel their clients from the initial meeting. Topics will include copyright laws, trademarks, patents, trade secret elements and strategies, publicity/privacy, libel issues, and ethical considerations. Internet issues will also be discussed—from owning a website to music webcasting, from online trademark issues to potentially losing trade secrets via the Internet. The program is designed for general practitioners, business and commercial attorneys and intellectual property lawyers with moderate to advanced practice experience.

What, exactly, is covered by copyright law and when does it accrue? How long will it last? In this segment, the speaker answers each of these questions, as well as those regarding copyright registration and enforcing copyright claims.

In this segment, the speaker discusses Trademark law coverage, the cost and benefits of trademark registration, and enforcing trademark claims. The distinction between common law and registered marks are also discussed.

This segment examines the various measures that copyright owners can take to protect their online copyrights, including maximizing potential for recovering damages. The speaker also discusses the implications of the Digital Millennium Copyright Act (DMCA) on ISPs and website providers, as well as the implications of the Digital Performance Rights Amendment (DPRA) on those ISPs and websites trying to monetize music online.
