Saper Law helps its client overcome a Texas County TRO

Although Saper Law handles litigation involving temporary restraining orders and injunctions, the subject matter usually involves intellectual property or trade secret missapropriation—not mud pits, fire jumps, and obstacle courses.

Last Thursday, Saper Law received the following call from one of its client:

“Daliah, there are three Kaufman County Sheriffs at our event site physically blocking any construction or preparation for our upcoming event.  We’re expecting 30,000 people– flying in to Texas from all over the country– in less than two weeks! They handed us a Temporary Restraining Order and said if we try to move forward, we will face harsh penalties. What do we do?!”

A flurry of phone calls later, Saper Law secured a copy of the TRO, hired local Texas counsel, and started poring over the Texas Mass Gathering Act.

What was Kaufman County’s cause for concern?

The client’s event is a 3.5 miles running event with various obstacles like cargo nets, hay bales, waist-deep water complete with logs, and a fire pit. It is the ultimate event for thrill-seeking athletes, held on some of the nation’s most demanding and unique terrain.

To overcome the TRO, Saper Law needed to help its client convince the Court, and Kaufman County officials, that event was professionally organized and safe. The company had arranged for emergency situations, was working with local police and fire departments to control crowds, and had the full cooperation of partnering venues.  In addition, Kaufman county would benefit economically from the large influx of people visiting the area.

The arguments worked.
