Providers of internet based services such as video sharing platforms, auction sites and communications forums are frequently targeted by plaintiffs seeking redress for content posted by users to those services. For example, YouTube has been the target of numerous copyright infringement lawsuits, eBay has been accused of facilitating widespread trafficking in counterfeit and infringing goods, and MySpace has been criticized for not doing enough to protect its users from real-world harassment and abuse. The question of whether and to what extent the intermediary should be responsible for the unlawful conduct of its users is a perennial question of internet law. This seminar will explore these issues from a variety of viewpoints.
