Block Club Chicago recently interviewed Daliah Saper for its February 14th article about copyright and fair use issues surrounding the use of a photograph in a Chicago political campaign.
Alderman Joe Moore (49th) used a photo taken by local photographer Sarah-Ji Rhee and photojournalist Emile Wamsteker without asking for permission and incorporated into his campaign flyers. The photographers spoke out publicly about the unauthorized use, citing copyright violations.
In the article, Daliah explained the concept of Fair Use as an affirmative defense to copyright infringement and provided examples of how the defense could be asserted.
