On September 24th, 2020 FOX 32’s Anita Padilla and Scott Schneider interviewed Social Media attorney, Daliah Saper about a lawsuit filed against Facebook earlier in the week.
The partner of a protestor killed in Kenosha Wisconsin on August 25th, along with three other individuals, sued the social media platform over its failure to remove posts that rallied right-wing counter-protests that led to two protestor deaths.
Daliah explained that although Facebook’s CEO Mark Zuckerberg publicly admitted that Facebook committed an “operational mistake,” the platform is likely immune to liability. The platform has no legal obligation to moderate its content. Any moderation is optional and done for the betterment of the community. However, as Daliah pointed out, lawsuits like these are important because they intensify scrutiny of Facebook’s actions and help to impose a sense of public responsibility upon the platform.
