Fox 32 ChicagoNOW Interviews Daliah Saper About Landmark Social Media Cases and Platform Design Liability

By Categories: News, Press

Fox 32 ChicagoNOW recently interviewed Saper Law founder Daliah Saper about a wave of high-stakes lawsuits that could fundamentally reshape how social media companies are held accountable for harm caused by their platforms.

During the interview, Daliah explained that for years, technology companies have largely avoided liability for harmful online content by relying on Section 230 of the Communications Decency Act. These new cases, however, mark a significant shift. Instead of focusing on third-party content, plaintiffs are challenging the way platforms themselves are designed, alleging that certain features were intentionally engineered to drive compulsive use and cause harm, particularly to young users.

The interview addressed the similarities in litigation strategy to past lawsuits against tobacco companies, where liability was not based on individual choice alone, but on whether products were deliberately designed to be addictive despite known risks. If courts accept this framing, social media companies could face substantial financial exposure and be forced to change how their platforms operate going forward.

With billions of dollars potentially at stake, Daliah emphasized that these cases carry major bottom-line implications for the tech industry, especially as an industry that remains relatively under-regulated. Recent settlements by Snapchat and TikTok underscore the seriousness of the claims and the growing pressure on social media companies to reassess their risk exposure.

Finally, Daliah noted that jury trials introduce a layer of unpredictability that tech companies have largely avoided in prior Section 230-based dismissals. Jurors will be asked to weigh complex questions about accountability, product design, and harm, making these cases some of the most consequential social media trials to date.
