Daliah Saper Presents on Doxing Legislation at Internet Law Leadership Summit

By Categories: News, Press

Last week, Daliah Saper presented at the Internet Law Leadership Summit in Las Vegas, an annual gathering of leading internet law practitioners from across the United States, Canada, and Europe. The invite-only event brings together attorneys to examine emerging developments and debate the cases, legislation, and policies shaping the field.

Daliah’s presentation focused on the rapidly evolving legal landscape surrounding doxing—the unauthorized publication of identifying or private information (such as home addresses, phone numbers, or workplace details) with intent to harass, threaten, or cause economic, emotional, or physical harm.

Illinois Civil Liability for Doxing Act

Daliah highlighted the Illinois Civil Liability for Doxing Act, which took effect in 2024 and provides a private right of action for individuals whose personal information is intentionally published in ways that place them at risk of death, bodily injury, or stalking. As online harassment continues to intensify, Illinois joins a growing number of states enacting targeted legislation to address doxing—yet the legal solution is far from settled.

First Amendment Tensions

The most compelling part of the presentation centered on the Act’s inherent conflict with First Amendment protections. Critics argue that doxing statutes risk chilling protected speech; supporters counter that harassment and true threats fall outside constitutional protection. This tension—between preventing real-world harm and preserving free expression—remains genuinely unresolved and deserves serious engagement rather than easy answers.
